Terms of sale and use

These terms govern your use of genpix-ai.com and any credit you buy on it. They are written to be read, not to be survived. If a clause is unclear, ask before you buy — we would rather explain it than argue about it later.

1Who you are dealing with

GenPix AI is a service operated by an individual trader established in France. No VAT is charged on any order (TVA non applicable, art. 293 B du CGI). The publisher’s name, registration number and statutory address are not printed on this site; they are sent in full, to anyone who asks and without a reason having to be given, from the address below — see the Legal notice. We call ourselves “we” below. You are “you”. If you are buying in the course of a business, say so — some consumer protections below apply only to consumers, and we would rather you know which ones.

2What the service does

You write a description, optionally attach reference photos, and we generate images from it using automated image-generation systems operated on our behalf. The service is provided as it is: image generation is probabilistic, and we cannot promise a particular result from a particular prompt. That is the nature of the technology, not a defect.

A generation that produces an image is a delivered service, even if you dislike the image. Section 7 explains what we do when the system genuinely fails, which is a different situation and one we do pay for.

3Your account

3.1The free trial, without an account

You can generate your first images without creating an account. Using the service that way still means accepting these terms — section 6 in particular applies to a trial exactly as it applies to a paying customer.

What happens with your prompts and reference photos during a trial is set out in our privacy policy, §2.1 and §2.2. The short version: they are stored as you type them, and the operator can read and view them.

4Credit — what it is, and what it is not

Credit is prepaid payment for future generations on this site. It is not electronic money, it is not a deposit, it cannot be transferred to another user, and it cannot be exchanged for cash except where the law requires it (see Refunds).

If we ever change the price per image, the new price applies to generations made after the change. Credit you already hold keeps its face value in euros; what changes is how many images it buys. We will tell you before that happens.

5Payment

Payments are handled by Stripe. Your card details are entered on Stripe's page and never reach our servers. Your bank statement will show GENPIX* CREDITS.

Prices are shown in euros. Where VAT is due on your purchase it is included in the price shown at checkout, and your receipt states it.

Credit is added to your wallet when Stripe confirms the payment to us, normally within seconds. If the money left your account and the credit did not arrive within an hour, write to us with the date and amount and we will find it.

Every top-up produces an invoice, emailed to you by Stripe as a PDF. Keep it: its footer repeats, word for word, the consent you gave at checkout, so you never have to take our word for what you agreed to.

5.1Immediate supply, and your right of withdrawal

Credit is digital content supplied immediately. Before each top-up you tick a box that says three things in one line: that you accept these terms, that you ask us to hand the credit over at once, and that you understand that, for the credit you then spend, you lose the 14-day right of withdrawal you would otherwise have under article L221-18 of the French Consumer Code. The last two are written out on the box itself, in those words — the acceptance of these terms is not what waives the right, and could not be. This is the exception at article L221-28 13° of that code, and article 16(m) of directive 2011/83/EU. The exact sentence is quoted, and explained, in section 2 of the Refunds page.

What you keep: for 14 days from the top-up, no reason needed, you can get back what you paid for the credit still sitting unspent in your wallet. Where a pack carried bonus credit, the bonus is a discount and has no cash value, so the refund is the paid share of what is left — the formula, with a worked example, is in section 4 of the Refunds page. What you give up: generations already paid for are delivered and are not undone. That page also lists the requests we refuse as abuse of the right, and it forms part of these terms.

6What you may and may not generate

You keep whatever rights you have in the images you generate, and we do not claim ownership of them (section 8). In exchange, you carry responsibility for what you ask for. You must not use GenPix AI to produce:

Reference photos: you must have the right to upload them. Uploading a photograph of another person means you are telling us you have their permission. That is the single rule that matters most on this site, and the one we enforce hardest.

We may refuse, interrupt or remove a generation that breaks these rules, suspend or close the account or trial session behind it, and where the content is criminal, report it to the authorities with the records described in our privacy policy. Credit spent on a generation removed for a breach of this section is not refunded.

Who decides. To apply this section at all, we have to be able to see what is asked of the service: prompts and reference images are stored when you type them and can be read and viewed by the operator, whether or not a generation was run, and whether or not you have an account (privacy policy §2.2). The judgement of whether a request breaks this section is the operator's, made case by case and without a prior notice period. It is not a machine verdict and it is not delegated. If you believe a decision about your content was wrong, write to [email protected] — it reaches the person who made it, and section 12 sets out how to escalate beyond us.

7When the system fails

If a generation fails on our side — the system errors, times out, or returns nothing — the credit is returned to your wallet automatically. You do not need to ask. If you see a failed generation that was still charged, tell us and we will put it back.

We do not guarantee uninterrupted availability. We do maintenance, providers have outages, and things break. What we commit to is that you are never charged for an image you did not receive.

8Who owns the images

As between you and us, the images you generate are yours, including for commercial use. We claim no ownership and take no cut of what you do with them.

Two honest caveats, because pretending otherwise would not help you:

Images stay private by default. They appear publicly on this site only if you press the publish button on that specific image, and you can withdraw it at any time.

9Our liability

Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit — and under French consumer law, the legal guarantee of conformity applies to this service whatever these terms say.

Beyond that: we are liable for foreseeable loss caused by our failure to provide the service properly, and our total liability is capped at the greater of 100 € or the amount you paid us in the twelve months before the claim. We are not liable for what you do with the images you generate, nor for loss of profit or business opportunity.

10Suspension and closure

We may suspend or close an account that breaches section 6, that attacks or attempts to overload the service, that resells access, or that is used for fraud or chargeback abuse. Except where the breach is serious enough to make it inappropriate, we will tell you why and give you a chance to answer.

If we close your account and you have not broken these terms, we refund your remaining paid credit. If we close it because you did break them, we do not.

11Changes to these terms

We may update these terms. Changes affecting credit you already hold, prices, or your rights take effect 30 days after we tell you by email and on this page, and you may close your account and reclaim unspent paid credit within those 30 days if you disagree. Corrections of typos and clarifications take effect immediately.

12Law, and how to complain

These terms are governed by French law. If you are a consumer resident in the EU, you keep the protection of the mandatory rules of your own country, and you may sue in your own courts.

Complain to us first — [email protected]. We answer every complaint within 14 days. If we cannot agree, EU consumers may use the European Commission's online dispute resolution platform, and French consumers may refer the dispute free of charge to a consumer mediator.
